Former President Donald Trump declined to take credit for Friday’s Supreme Court reversal of the 1973 ruling in Roe v. Wade.
“God made the decision,” the former president told Fox News. His appointment of three Conservative Justices to the Supreme Court supports the maxim that God helps those who help themselves.
“This is following the Constitution, and giving rights back when they should have been given long ago,” he added. Mr. Trump noted the ruling does not end abortion, it just puts the decision about granting abortion access to individual states. He said that is where the power to make such decisions has always belonged.
“I think, in the end, this is something that will work out for everybody,” the 45th president reportedly said.
Friday’s 5-4 majority opinion in the Mississippi case Dobbs v. Jackson Women’s Health Organization, which centered on a Mississippi law banning abortions after 15 weeks of pregnancy. The red state of Mississippi asked the high court to overturn a lower court ruling that kept the new abortion law from taking place.
The decision shocked many abortion-rights supporters despite Justice Samuel Alito’s draft opinion regarding the case being leaked to Politico, in May.
Roe v. Wade was highly controversial since the day the court affirmed a “right to abortion” in its 7-2 decision. Opponents complained there was no basis in law and the Supreme Court made the law up out of whole cloth. Roughly half of the states objected to begin required to allow abortions to be performed within their state borders.
In the 1992 decision in Casey v. Planned Parenthood, the high court said states could add some restrictions to abortions after the fetus reached “viability” but could not outright ban abortion access.
When the Supreme Court published their decision Friday in Dobbs v. Jackson Women’s Health Organization, a number of state laws automatically reverted back to pre-existing bans on abortions. All told, 13 states will have an abortion ban in place ranging from immediately to one month from Friday.
Other states had new laws banning or restricting abortions blocked by state courts but those stops will be removed in light of the high court’s decision.
“The Constitution does not prohibit the citizens of each State from regulating or prohibiting abortion,” argued Justice Alito, who delivered the majority opinion. “Roe and Casey arrogated that authority. We now overrule those decisions and return that authority to the people and their elected representatives.”
Chief Justice John Roberts voted with the majority in the Dobbs case, making that opinion a 6-3 decision but he did not join the five Conservative justices who went the extra step of overturning Roe.
The former president’s son, Donald Trump, Jr., posted a meme to his Truth account that suggested overturning Roe v. Wade was a consequence of former President Barack Obama making fun of his father at a 2011 White House Correspondent’s dinner.
Trump denied, in 2011, that he was upset by Mr. Obama’s jokes about him. Indeed, he said he had a good time. So, it’s curious that his son suggested otherwise. Curious, but funny.
